What to Expect

This must-attend workshop will review the different wage orders; Wage Orders 4 (office workers), 15 (in-home workers), and 5 (hospital workers). It is these three Wage Orders that govern recordkeeping requirements, meal and rest period requirements, meal and lodging credits, applicability of the personal attendant exemption, and requirements for live-ins, as these requirements apply in the home care industry.  The program will also review each of the wage order requirements and how it can affect operations.  Attendees will learn how to apply these requirements correctly in order to avoid liability.  There will also be practice questions and exercises including a step-by-step analysis/discussion on how-to handle an actual wage & hour claim.  The last element will be a mock claim, discussing arguments for and against the claimant’s position, and group discussion.

Learning Objectives

  • Understand the basis of California’s wage & hour laws – what they are and where they come from
  • Understand basics of exemptions – how does a worker classify as exempt, whether an officer worker or a caretaker
  • Understand when extra pay is required – reporting time pay, split shift pay; and when and how employers can charge for uniforms and equipment
  • Understand which employees are entitled to a meal and/or rest period, and how to provide it to them
  • Understand what records are required to be kept regarding employees’ payroll (including paystubs) and hours worked, and how to make sure time is accurately reported
  • Understand what the potential consequences are for failing to comply with Wage & Hour laws
Who Should Attend?

Recommended for staff that must have a solid understanding of the Fair Labor Standards Act (Wage and Hour Law) to better determine their agency’s legal and payroll responsibilities, avoid wage and hour violations that result in steep penalties, and avoid costly litigation.

About the Presenters

Continuing Education Credit

Continuing Education Hours will be provided to participants who attend the program in its entirety. Provider approved by the California Board of Registered Nursing (Provider # CEP2463) and by the California Board of Behavioral Sciences (Provider #PCE588) for up to six (6) contact hours of continuing education. You must be present for the entire workshop to earn continuing education hours.  No partial credit can be given.

CANCELLATIONS:
Received 10 business days prior to the program date are subject to a 20% handling fee. Cancellations must be in writing. NO REFUNDS will be issued for cancellations received within 10 business days of the program. Refunds will NOT be made for no-shows. However, substitutions will be allowed. Should CAHSAH cancel the program, a full registration fee refund will be issued.
